Sukhjit Dhaliwal an Associate Director of NCM on the Client and Investor Support Team discussed reverse solicitation and the European Securities and Markets Authority (ESMA) guidance that was issued on this topic on 13 January 2021. The ESMA guidance follows the current FCA focus on consumer protection.
Included within the guidance was the advice that every communication means used should be “considered to determine if the client or potential client has been subject to any solicitation, promotion or advertising on the firm’s investment services, activities or financial instruments”. Such solicitation etc should be considered regardless of the person through whom it is issued.
